Question

Our practice has two part-time partners, plus two full-time husband and wife partners, who own the premises, which is attached to their house. They receive all the rental income from our PCT. We are struggling to draw up an agreement that is fair regarding who is responsible for maintenance and other costs?

Answer

The fairest way is to assume a landlord and tenant situation with a lease in line with the terms used by the District valuer when calculating notional rent for reimbursement. So the two owner partners are the landlord, and the non-property owning partners the tenants.

The landlord is responsible for: the roof, external windows and doors; external drainage; building insurance; car park repairs and other hard landscaping; and external decorating.

The tenants are responsible for: internal drainage and toilets; heating and plumbing; telephone system; soft landscaping such as gardening; internal decorating and carpets; and repairs to electrical wiring.
